Terms and Conditions
1. General provisions.
1.1. These purchase–sale rules in the online store 7ievosnamai.local, 7in.lt or 7in.lv, hereinafter referred to as the Rules, establish the mutual rights, duties and responsibility of the buyer and the seller MB HOW when purchasing goods in the online store 7ievosnamai.local, 7in.lt or 7in.lv (hereinafter – the online store).
1.2. Please carefully read these Rules. By submitting an order for goods, the buyer also confirms that he has familiarized himself with these Rules, they are clear and understandable to him and the buyer undertakes to comply with them.
1.3. The seller has the right to change or supplement these Rules at any time. The Rules valid at the time of submission of the order apply to the relationship between the buyer and the seller. By submitting an order after the change of the Rules, the buyer confirms that he agrees with the changes, they are clear and understandable to him and he undertakes to comply with them.
2. Conclusion of the contract.
2.1. The purchase–sale contract between the buyer and the seller is considered concluded from the sending of confirmation of acceptance of the order to the buyer to the email address specified by him. Upon conclusion of the purchase–sale contract, these Rules become an integral part of the purchase–sale contract.
2.2. All contracts concluded with buyers are stored in the online store.
2.3. The place of conclusion of the contract is considered to be the Republic of Lithuania.
2.4. The assortment of goods, their quantity, price and other conditions specified in the buyer’s order become a mandatory and integral part of the contract from the sending of confirmation of acceptance of the order to the buyer to the email address specified by him.
3. Price of goods.
3.1. The seller has the right to change the prices of goods sold in the online store at any time.
3.2. Prices in the online store are indicated with VAT.
3.3. Delivery costs of goods are not included in the price of goods, they are calculated during the order and added to the final price of the order.
3.4. The price of the goods which the buyer undertakes to pay to the seller is the price indicated in the buyer’s shopping cart at the time of submission of the order, regardless of the fact that later, after sending confirmation of acceptance of the order to the buyer, the price of the ordered goods changes.
4. Delivery, acceptance of goods. Ownership right to goods.
4.1. The seller undertakes to provide the buyer with quality goods.
4.2. The buyer undertakes to check the quality of goods and their compliance with the order at the time of delivery of goods to the buyer. If the delivered goods or their packaging are of poor quality or do not comply with the buyer’s order, goods are missing, the buyer must record this in the invoice. The entry must be signed by the buyer and the seller or their authorized persons (e.g. courier).
4.3. The buyer has the right to refuse to accept from the seller only those goods or their part which are of poor quality or do not comply with the buyer’s order.
4.4. The seller or his authorized person confirms his agreement with the entry made in the invoice regarding the defects of goods with his signature. Having confirmed that the goods delivered to the buyer are of poor quality or do not comply with the buyer’s order, the seller undertakes within 10 (ten) working days (if the goods were delivered outside Lithuania – within 30 (thirty) working days) to replace defective or non-compliant goods with suitable goods complying with the order. In such case the costs of repeated delivery to the buyer are paid by the seller.
4.5. If the buyer accepts the goods and does not record defects of goods in the invoice, it is considered that the delivered goods comply with the usual quality requirements for such goods and the buyer’s order.
4.6. Ownership right to goods passes to the buyer from the day of full payment for them.
4.7 The seller has the right not to sell ordered goods or not to apply discounts in cases when:
1. More than 50 (fifty) units of goods are ordered or for more than 300 (three hundred) EUR.
2. Within 30 calendar days several orders are submitted by the same buyer or from the same IP address, by which the total quantity of purchased goods within 30 days exceeds 50 (fifty units) or the amount exceeds 300 (three hundred) EUR.
Orders specified in this point are considered wholesale and their execution and payment must be coordinated with the seller separately.
5. Return of goods.
5.1. Goods are returned in accordance with the Order No. 217 of the Minister of Economy of the Republic of Lithuania of June 29, 2001 “On approval of rules for return and exchange of goods” (http://www3.lrs.lt/pls/inter3/dokpaieska.showdoc_l?p_id=141450) and the rules “Sale of goods and provision of services when contracts are concluded using means of communication” approved by Order No. 258 of the Minister of Economy of the Republic of Lithuania (http://www3.lrs.lt/pls/inter3/dokpaieska.showdoc_l?p_id=148061).
A request or complaint regarding a product purchased in our store can be submitted to us by email info@7ievosnamai.local. If no solution is found, you can submit a complaint to the State Consumer Rights Protection Authority (Vilniaus g. 25 Vilnius, email tarnyba@vvtat.lt) or fill in a request form on the ODR platform http://ee.europa.eu/odr/.
6. Liability.
6.1. The buyer is fully responsible for the compliance of the information provided in the order with reality and assumes responsibility for all consequences arising from the inaccuracy of the information provided by him.
6.2. Civil liability of the seller for losses (damage) is applied only in cases when they are caused due to intent or gross negligence of the seller or his employees.
6.3. The amount of losses which the seller must compensate is limited to the price of the goods ordered by the buyer.
6.4. The seller does not compensate indirect losses (lost income, etc.).
6.5. The seller is not responsible for disruptions of the online store operation caused by failures in systems belonging to third parties, communication networks, stations or disruption of services of third parties used by the online store.
7. Protection of intellectual property.
7.1. Names of goods or companies indicated in the online store may be trademarks and in such case intellectual property to them is protected in accordance with the procedure established by legal acts.
7.2. The content of the online store website is the property of MB HOW or suppliers of goods, protected by laws. Without written consent of MB HOW copying or use of the website or its part is prohibited.
8. Personal data.
8.1. Personal data of buyers are used and processed in accordance with REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 (http://eur-lex.europa.eu/legal-content/LT/TXT/PDF/?uri=OJ:L:2016:119:FULL&from=EN ). Our company asks persons-clients to provide only those personal data which are necessary for delivery of goods and communication with the client regarding delivery. 8.2. Our company MB HOW, which represents the trademark “7 Ievos namai” and “7IN֧” registered address – Tilžės g. 1-2, Šilutė, company code 305261893. We collect only data necessary for sending goods, contacting our buyers, informing about news, offers and promotions, receiving feedback about the purchased product or provided service: email, names and surnames, and when required by delivery conditions, delivery address.
8.3. We guarantee that we process your data in accordance with Regulation (EU) No. 2016/679. We guarantee that your personal data will never be accessible to third parties or used not in accordance with the reasons listed above.
8.4. If the buyer does not inform us about the wish to unsubscribe from the newsletter, he may receive newsletters of 7ievosnamai.local, 7in.lt or 7in.lv about our news, discounts, offers and similar. 9. Final provisions.
9.1. The law of the Republic of Lithuania applies to the relations between the buyer and the seller arising from purchasing goods in the online store.
9.2. All disputes arising between the buyer and the seller are resolved by negotiations, and if not resolved – in court in the city of Vilnius.
9.3. All issues not discussed in these Rules are resolved in accordance with legal acts of the Republic of Lithuania.
